Formation Status
Ballast Mutual is structured as a member-owned mutual insurance company to be domiciled in the State of Tennessee. Licensing and regulatory filings will be completed in coordination with specialized captive counsel and the Captive Manager prior to the first policy issuance.
Coverage Territory
Although Ballast Mutual will be domiciled in Tennessee, the program works with the insurance company that issues the ultimate policy so that coverage can be written in all 50 U.S. states. Members whose work extends into Canada are also contemplated within the program’s coverage design. Where foreign liability outside the United States and Canada is required, the member’s retail broker can arrange that coverage with another carrier.
Regulatory Approach
The program is designed to operate with an admitted Policy Issuer so that members receive conventional insurance policies acceptable to Department of Energy, utility, and prime-contractor counterparties. Economic risk is retained within the Independent Accounts and Group Account of Ballast Mutual, with reinsurance providing catastrophe protection.
The Captive Manager is responsible for regulatory filings, financial reporting, and ongoing compliance with the requirements of the Tennessee domicile and any applicable fronting arrangements.
