Information Confidentiality

Ballast Mutual and Bearing Risk recognize that participants in the nuclear supply chain operate under exacting commercial, regulatory, and competitive conditions. Protection of proprietary and sensitive information is therefore a foundational obligation of the program.

Permitted Information Sharing

The only category of information that may be shared across the program, and then solely on a controlled and anonymized or aggregated basis where appropriate, is information that advances collective nuclear safety and operational excellence. Specifically:

  • Industry-wide best practices, lessons learned, and non-proprietary technical insights that strengthen nuclear safety culture, quality assurance, and risk mitigation across the supply chain.
  • Information whose controlled dissemination demonstrably reduces the potential liability exposure of participating members in the ordinary course of their nuclear-related work.

Such sharing is undertaken solely to elevate industry standards and to support the mutual’s long-term underwriting integrity. It is never used for commercial advantage of any single participant or of the program sponsor.

Strict Confidentiality Obligations

All other information—including but not limited to trade secrets, proprietary processes, pricing and commercial terms, customer lists, technical designs, manufacturing methods, claims details specific to a member, financial data, and any other information a member reasonably regards as confidential—shall be maintained in strict confidence.

This obligation is formalized through binding confidentiality agreements executed among:

  • The member (and, where applicable, the member’s retail broker)
  • Bearing Risk (program sponsor)
  • Ballast Mutual
  • The Policy Issuer (underwriter)
  • The designated Claims Handler and any other claims-management or program-administration vendors

These agreements impose reciprocal duties of non-disclosure, limit use of confidential information to the legitimate purposes of underwriting, claims handling, and program administration, and require appropriate technical and organizational safeguards. Unauthorized disclosure or use constitutes a material breach and is subject to the remedies set forth in the governing participation and service agreements.
